DEFINITIONS

Factory Cameras”: The camera repair company. “The Customer”: The person, firm or company for whom repairs are performed. “The Goods”: The equipment entrusted for repair.

1. WORK TO BE DONE

Factory Cameras shall have the sole discretion to decide the nature, extent and method of repairs and the type of replacement parts to be used. No liability is accepted for replacement parts as set out in these conditions.

2. DELIVERY DATES

2.1 All dates given by Factory Cameras for completion of repairs are estimates only and Factory Cameras shall not be liable for any loss or compensation resulting from failure to meet projected dates. Failure to meet stated dates shall not entitle the Customer to cancel the order.

3. ESTIMATES

3.1 Where an estimate for the price of repairs is given by Factory Cameras it shall not be obligated to commence work until an acceptance and payment are received from the Customer. Factory Cameras may, at any stage, submit a further or revised estimate if the condition of the equipment warrants.

3.2 When Factory Cameras supplies a revised estimate not accepted by the Customer, Factory Cameras reserve the right charge for handling and examination, usually $25.00 CAD. No liability can be accepted by Factory Cameras for the re-assembly of equipment dismantled for the purpose of examination.

3.3 Factory Cameras will provide a full refund for repairs in the unlikely event that repairs are unable to be completed only when it does not conflict with section 3.2. This does not include failure to meet a deadline.

3.4 If goods are returned at a later date to Factory Cameras for repair, Factory Cameras shall be under no obligation to complete repairs for the cost previously estimated or to refund charges made for the estimate declined or not accepted.

3.5 If an estimate is not accepted within 90 days from the date of the estimate, Factory Cameras shall be entitled to dispose of the goods or charge a storage fee of $50.00 CAD.

3.6 Once work and estimate has been approved by the Customer, they are agreeing to these Terms and Conditions. If work has begun and subsequently cancelled this will be subject to a “kill fee” to be determined by the technician. This is not the case for the majority of requoted work or when there are exceptional circumstances. The decision to charge is made by the Factory Cameras technician and is non-negotiable.

3.7 Factory Cameras provide written estimates free of charge. Estimates are subject to revision in the event that further damage is revealed in the process of repair.

3.8 Factory Cameras may keep a record of text messages and emails for proof of business transactions.

4. PAYMENT AND DISPATCH OF GOODS

4.1 Payment in full is required only once the repair has been completed or before any parts to be ordered.

4.2 Unless Factory Cameras has agreed to open a credit account for the Customer no Goods will be dispatched except on receipt of payment.

4.4 If the Customer fails to pay the outstanding balance on statements of account for services rendered within three months of the date of completion, Factory Cameras may sell any or all Goods and may retain from the proceeds of such sale any amount sufficient to defray costs of repairs and expenses incurred in attempting to seek remuneration from the Customer. No interest shall be payable on any balance retained by Factory Cameras.

4.5 Factory Cameras shall charge a storage fee for uncollected paid goods after 90 days of the repair completion. This charge is $10.00 CAD per subsequent week payable in full upon collection of items. No goods will be released without complete payment for services rendered paid to Factory Cameras.

5. COMPANY’S LIABILITY

5.1 Factory Cameras will be responsible for Goods from the Customer until the Goods are delivered back to the Customer. All Goods delivered by Factory Cameras shall be insured at the current secondhand value.

5.2 Factory Cameras will not be responsible for loss or damage whatsoever claimed by reason of repairs carried out, nor any damage, injury or loss arising from the use of the Goods. No claims whatsoever will be considered for loss or damage to photographic or video materials, tubes, batteries or lamps nor will Factory Cameras be responsible for parts or assemblies requiring replacement being sent to suppliers by way of sample or replacement.

5.3 Factory Cameras will not be responsible for any accessories left by the Customer accompanying the Goods. Any accessories are left at the Customer’s risk, i.e film, tape, filter, cap, strap, card, batteries, charger.

6. CUSTOMER LIABILITY

6.1 The Customer warrants that the Goods are not dangerous or potentially dangerous and shall indemnify Factory Cameras against any loss or damage caused by breach hereof.

6.2 If the Customer is not the owner of the Goods, the Customer shall at all times be deemed to be acting as the agent of the owner and not the agent of Factory Cameras.

7. GUARANTEE

7.1 Goods are accepted by the Customer on the condition that their value does not exceed the current secondhand value of such equipment.

7.2 Factory Cameras guarantees repairs against defects in workmanship, or defects in parts or replacements supplied for the following periods: if the equipment is repaired or serviced in accordance with our estimate the whole item is guaranteed for 90 days. If a partial repair is carried out, only the part repaired is guaranteed. Guarantees are only valid with the original invoice of the specific repair or purchase.

7.3 The guarantee period starts from the date the Customer collects Goods or receives shipment of returned Goods.

The guarantee shall extend to:

7.2a Any removable module or sub-assembly fitted to the equipment – for example, removable lenses, meters, film backs or cartridges if such items have been repaired.

The guarantee shall NOT extend to:

7.2b No proof of receipt. Without the original invoice given at the time of collection, Factory Cameras will not honour a guarantee either for a purchase or repair.

7.2c A late collection of goods. It is the responsibility of the Customer to collect equipment as soon as the repair is completed to make claims within the stated guarantee period. Non-collection will not extend the guarantee period.

7.2d Damage or deterioration caused in transit or shipping, or negligence of any party other than Factory Cameras, misuse, accident, or any attempted repair by any party other than Factory Cameras.

7.2e Motors, meters, tubes, valves, transistors, lamps, and batteries save where such parts have been fitted by Factory Cameras and replacement is covered by the guarantee or warranty from the suppliers of these items or parts.

7.2f Any claim under this guarantee can only be considered if received by Factory Cameras in writing within the stated guarantee period, and the Goods properly packaged together with a list of alleged defects are sent at the Customer’s expense to Factory Cameras. Factory Camera’s subsequent decision about the extent of its obligation will be final. IT IS THE RESPONSIBILITY OF THE CUSTOMER TO SEE THAT GOODS ARE TESTED WITHIN THE PERIOD OF THE GUARANTEE. NON USE OF THE EQUIPMENT DOES NOT EXTEND THE PERIOD OF THE GUARANTEE.

7.2g Factory Cameras shall not extend the guarantee on any purchase/repair if a repair is carried out under guarantee by any party other than Factory Cameras.

7.2h Factory Cameras shall on no account be liable for any charges made by another party for repairing the Goods save where such repairs are expressly authorized by Factory Cameras in writing.

7.2i Factory Cameras may at any time fulfil its obligations under this guarantee by returning the Goods to the Customer and refunding the repair charge paid.

8. EQUIPMENT RENTAL

8.1 The full amount of goods is to be paid prior to the release of equipment from Factory Cameras as the deposit. Once the equipment has left premises of Factory Cameras the Customer is liable for the equipment rented. Any damage/user error/theft is the responsibility of the Customer and will result in part or full deposit being retained.

8.2 Rental charges are on a daily rate depending on equipment and are refunded from the deposit taken. Failure to meet the deadlines will result in further charges at the standard rate per day up to a maximum value of the goods rented.

8.3 Factory Cameras shall not be responsible for any material lost during use of equipment or third party equipment.

9. VARIATION

11.1 These conditions shall not be varied or altered by the Customer. Any order conditions specified by the Customer contravening any conditions specified by Factory Cameras will be void.

11.2 Factory Cameras has the right to amend/alter their terms and conditions without prior notification of the Customer.

These conditions and any agreement between the Customer and Factory Cameras shall be governed by British Columbia Law.
